Terms & Conditions and Rental Agreement
These Terms & Conditions constitute a legally binding agreement between the primary guest ("Guest") and Majestic Arizona Properties LLC, doing business as Elara Retreats ("Host"). By confirming a reservation at our Sedona property, the Guest agrees to abide by all financial terms, liability waivers, and property rules outlined below.
1. Payment & Cancellation Policy

Payment Schedule: A 50% deposit of the total reservation cost is due at the time of booking to secure your dates. The remaining 50% balance is automatically collected 30 days prior to your check-in date. Bookings made within 30 days of arrival require full payment upfront.

Cancellation Policy: Travelers who cancel at least 30 days before check-in will receive a 100% refund of the amount they've paid. If you cancel between 14 and 30 days before check-in, you will receive a 50% refund. Cancellations made less than 14 days before check-in are non-refundable.

Travel Insurance: We highly recommend purchasing "Cancel for Any Reason" travel insurance to protect your investment against unforeseen circumstances, flight delays, or illness.
2. Security Deposits & Additional Fees

Security Deposit Hold: A temporary credit card authorization hold of $500 will be placed on your payment method 2 days prior to arrival. This is not a charge. The hold will be released within 7 days of your departure, provided no damages, missing items, or violations of the property rules are found by our inspection team.

Pet Policy & Fees: Approved pets are subject to a $200 non-refundable pet cleaning fee per stay. Bringing an unauthorized pet, or exceeding the approved number of pets, will result in the immediate forfeiture of your security deposit and potential eviction.

Payment Processing: All direct credit card payments and security deposit holds are processed securely via Lynnbrook Group.
3. Liability Waiver & Indemnification

Assumption of Risk: The Guest and all members of their party assume all risks associated with the use of the property and its amenities. Majestic Arizona Properties LLC is not liable for any bodily injury, illness, or death that occurs on the premises.

Personal Property: The Host is not responsible for the loss, theft, or damage of any personal belongings or valuables brought onto the property by the Guest or their visitors.

Indemnification: The Guest agrees to indemnify and hold harmless Majestic Arizona Properties LLC, its owners, and property managers from any claims, damages, or expenses arising from the Guest's use of the property.
4. Property Policies & House Rules
Check-In & Check-Out

Check-In (4:00 PM): Access is incredibly easy and flexible. You will be provided with a unique code for our smart keypad, allowing for keyless entry anytime after 4:00 PM.

Check-Out (11:00 AM): To help our cleaning team prepare for the next guests, we kindly ask that you depart by 11:00 AM and complete a few simple tasks before you go:

Turn off all lights and appliances.

Throw away all trash in the designated bins.

Ensure all doors and windows are fully closed and locked.

General House Rules

Age Requirement: The primary renter must be at least 25 years of age and must be present for the duration of the stay.

No Smoking: This is a strictly smoke-free property. Smoking, vaping, or the use of any recreational drugs inside the home or near open doors/windows is strictly prohibited.

Occupancy: Please ensure your guest count matches your reservation. Unapproved visitors or large events/parties are not permitted in order to maintain the quiet privacy of our neighborhood.
Pet Policy
We love animals and are happy to welcome one well-behaved pet to join your vacation, subject to a $200 pet cleaning fee. To ensure our home remains pristine for all guests, we kindly ask that you adhere to the following rules:

Pets are not permitted on any of the furniture or beds at any time.

Pets must never be left unattended inside the home or outside on the property.

Please clean up after your pet both inside and outdoors.
Smart Home & Technology Infrastructure
Elara Retreats is equipped with a premium, locally controlled smart home ecosystem designed to ensure your comfort and safety. Under no circumstances should any of the smart home devices be tampered with, moved, or unplugged.

Do Not Power Off: This includes the Hubitat smart hub, internet routers/extenders, smart thermostats, smart locks, and environmental sensors.

Why This Matters: Disconnecting these devices disrupts the climate control, security, and access systems for the property. Tampering with this infrastructure may result in a disruption of your service and an additional fee.
Security & Privacy
Your safety and the privacy of our neighbors are our top priorities.

Exterior Cameras: For security purposes, there are two exterior-only security cameras actively monitoring the property, including one located at the front door. These cameras do not face into any interior or private spaces.

Noise Monitoring: The home is equipped with an interior noise monitoring system. This device only measures decibel levels to ensure noise remains at a respectful volume; it does not record voice or sound.
5. Breach of Agreement
Failure to comply with any of the terms, conditions, or house rules listed above may result in immediate eviction from the property without a refund of the nightly rate, cleaning fees, or security deposit.
